HL Acquisition, Inc. (dba Hosta a.i., Hosta, we, our, etc.) respects the privacy of our customers, users, and visitors (you, your, etc.). This privacy policy (Policy) applies to this and any of our other Internet properties (each a Site and collectively, the Sites), mobile applications, products and programs, and all services, including consulting, support and training (with all of the foregoing referred to as Services).

By accessing or using a Site or engaging in Services (whether individually or on behalf of your organization) you signify that you have read, understand and agree to the terms of this Policy; and you consent to the collection and use of your information as described in this Policy, unless you opt-out as provided for hereunder.

We reserve the right to make changes to this Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Policy. You are encouraged to periodically review this Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Policy by your continued use of the Sites and Services after the date such revised Policy is posted. Unless we clearly indicate otherwise, we will use information in accordance with the Policy under which the information was collected.

PURPOSE OF THIS POLICY

This Policy discloses our practices regarding collection of information you submit to us in the course of using our Services and/or this Site, including personal information. “Personal information” generally refers to information that identifies, or can be used to identify you, such as your full name, account registration information, phone number, mailing address, and email address. 

INFORMATION WE COLLECT

This section describes the types of personal and other information we may collect about and from you, and how we use that information. We use the personal information we collect to carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and Services that you request from us; to improve our Services and the Sites; to provide you with information about other goods and services we offer that are similar to those that you have already purchased or inquired about; or to notify you about changes to our Services.

Information you provide to us directly

We may collect personal information, such as your name, phone number, address, industry, company and e-mail address when you register for our Services, sign up for our mailing list, or otherwise communicate with us.

Payment and transaction information.

Billing and other financial information (such as your credit card number or bank account number when combined with your billing address, and referred to collectively as Financial Information) will be required to purchase certain Services, or related to other transactions.  Tokenized information – which we do receive – is not Financial Information for purposes of this Policy because we cannot access bank or card numbers via the token.  Financial Information is processed and ultimately stored on a platform currently operated and controlled by our third-party provider, a PCI-compliant service that handles all of our payment processing.

Online Inquiries. When you submit an inquiry via the Services or Sites, we may ask for your first and last name, physical address, email address, phone number, company name, industry type, and certain other information from time to time. We request this information for identification purposes, and to communicate with you regarding your inquiry. If you provide your phone number, we may use that information to make direct dial calls, autodialed and prerecorded message calls, and to send text messages, from Hosta relating to our product and services.

Correspondence. If you correspond with us via email, we may gather in a file specific to you the information that you submit.

Images. When you capture imagery and submit it to certain of our Services, we may collect personal information which is depicted within the imagery you submit. This Policy applies only to personal information embedded in an image. Use of your image is subject to our licensing agreements.  We do use this information in aggregated form for analytics and artificial intelligence development, but the results of these activities do not contain or disclose any personal information that can identify an individual human being. We do not use this incidental information for any other purpose, but this information may be publicly displayed if you choose to display the underlying imagery publicly through certain of our Services.  If you do not wish to publicly display personal information depicted in the imagery you submit, you should either refrain from capturing such personal information in your imagery.

Geo-Location Information: We may request access or permission to and track location-based information from your mobile device while you are using the Service and/or Sites to provide location-based services.

Information gathered indirectly

URL, IP addresses, Device Information and Frequency of Use. Like many other online service providers, we collect and analyze information about our users’ utilization and navigation of our Services and Sites. This information helps us to design our Services and Sites to better suit our users’ needs, and we also use this information to share aggregated, anonymous information on the effectiveness of our Services with content owners and creators.

We track and collect data about how frequently you use the Services and/or Site, the time you spend actively using the Services and/or Site, and the pattern of actions you take in using the Services and/or Site.   We also track the URL that you visited before you came to our Site, the URL to which you next go, information about the browser through which you are accessing the Site and Services, and your Internet Protocol (IP) address. We use this information to help diagnose problems with our Services and Sites and to administer our Sites and Services. Your IP address also is used to help identify you and to gather broad location and demographic information.

Via Mobile Applications.  Our mobile applications also track and provide to us data about the ID,          make/model, camera, storage, location data, IP address, GPS, and other sensors, of the mobile device that runs the app. The mobile applications will track information when you are online, and may also track information when you are offline.  We may request access or permission to certain features from your mobile device, including your mobile device’s camera and/or sensors, photos and other features.  You may decline to provide access but our applications will not work as intended if you do.  We may request to access your device’s storage so the mobile app can store and access information like photos.      

From other sources.  We may obtain information about you from other sources. For example, we may receive background information in connection with an employment application; or via an email list purchased from or otherwise shared by a third party.

Meta Data.  Certain information may be gathered automatically through a variety of mechanisms, including non-identifying information, an IP address, referring URL, browser, operating system, cookie information, and Internet Service Provider (Meta Data).   Generally, this kind of information on its own cannot be used to identify you, but we may associate Meta Data with personal information you or someone authorized by you has provided to us.

COOKIES AND TRACKING DEVICES; SOCIAL MEDIA

Our Site and Services use cookies to distinguish you from other users of our Site and Services. This helps us to provide you with a good experience when you browse our website and also allows us to improve the Service.

Cookies are pieces of code that allow for personalization of the Site and Services experience by saving your information such as user ID and other preferences. A cookie is a small data file that we transfer to your computer’s hard disk for record-keeping purposes.

We use social media buttons or plug-ins on our Sites.  If you click on one of these buttons, your browser connects directly to the web servers of the associated social media network(s). If you are registered and logged into your account(s) on the(se) network(s), the network will receive and may store information about your use of our Sites. Even if you are not registered with the social media network or you are logged out when you visit our Sites, your IP address may be transmitted to and stored by these organizations. If you interact with our Sites through a social media network, then you may be permitting us to have access to information from your profile (such as your name, e-mail address, photo, gender, location, and the people/sites you follow). Each network has its own privacy policy. If you do not want the network to collect information about you or to share it with us, you must review the privacy policy on the network’s website and take the steps described there. In addition, you should log out of the relevant network before you visit our Sites.

HOW WE USE YOUR INFORMATION

Other than as provided for in this Policy, we generally use your information for the purpose for which it was submitted. For example:

  • If you provide personal. information as part of an employment application, we will use it to process your application and communicate with you about the same;
  • If you provide information to register for a Service, we will use your information to process the registration; or
  • If you request information from us, we will use your information to respond to and process your request, and may also add you to our database in order to provide you with additional materials and information in the future.

We also share or transfer your information as directed or authorized to do so by you or where you consent to such disclosure. We may aggregate your information with the information of other individuals in order to analyze and compare information as between users of our Sites and Services.

Other general uses include:

  • To communicate with you generally about our Sites and Services;
  • To solicit feedback about the Services and Sites; and
  • To facilitate your participation in events conducted by our collaborators or to otherwise make you aware of partners’ products and services.

Marketing and Advertising

From time to time, we may contact you with information about our Sites and Services. Most marketing messages we send will be by email. For some marketing messages, we may use personal information we collect about you to help us determine the most relevant marketing information to share with you. If you do not want to receive marketing messages from us, you will be able to tell us by selecting certain boxes on forms we use when we first collect your contact details. You can also change your marketing preferences at a later date by clicking on the unsubscribe link at the bottom of our marketing emails or logging into your account on our website and changing your preferences.

How do we use online analytics services and tailored online marketing?

Internet-Based Third-Party Advertising and Do Not Track Technology

Our Sites and certain Services use third-party advertising companies, which sometimes utilize third-party services for data collection and analytics.  These companies may use information about your visits to our Sites and to other websites in order to provide advertisements about products and services which may interest you. In so doing, we or these third parties may use cookies or other technologies for the purpose of collecting certain information about you. This may include your server activity logging, browser cookies, web beacons, and embedded scripts. 

We use this information for our own marketing purposes, including but not limited to informing, optimizing and serving ads to you online when you are browsing other websites. We use a variety of third-party services to collect and track this information. Each service has its own policy for handling Do Not Track signals and methods for opting-out of the collection of information for these purposes. By using the Sites and Services, you consent to potentially encountering third-party tracking technologies and you understand and agree that our statements under this Policy do not apply to the tracking technologies or practices of such third parties.

Third-Party Providers & Other Disclosures

Hosta will not share, rent, sell or otherwise disclose any of the information that we collect about you, except when we have your permission or in any of the following situations:

We may use third-party vendors, consultants, and other service providers to perform certain services on behalf of Hosta, such as hosting the Sites, hosting and processing your information and Meta Data, designing and/or operating features of the Sites and Services, performing analytic services that allow us to enhance the information we present to you either now or in the future, or performing other administrative and operational tasks. We may provide these vendors with access to your information, including personal information, to carry out the services they are performing on our behalf.

We may disclose and Meta Data to third-parties who work with us to support and improve upon our Services and Site.

We may disclose and transfer or sell information about you as part of a bankruptcy, corporate reorganization, merger, acquisition or other sale or transfer of Hosta’s assets or business. We may be legally obligated to disclose information about you to the government or to third parties under certain circumstances, such as in connection with illegal activity in connection with our Services or to respond to a subpoena, court order or other legal process. We reserve the right to release information that we collect to law enforcement or other government officials, as we, in our sole and absolute discretion, deem necessary or appropriate.

CALIFORNIA RESIDENTS

California law requires us to let you know how we respond to web browser Do Not Track (DNT) signals. Because there currently isn’t an industry or legal standard for recognizing or honoring DNT signals, we don’t respond to them at this time. We await the result of work by the privacy community and industry to determine when such a response is appropriate and what form it should take.

Under California law, California residents who have an established business relationship with us may choose to opt-out of our disclosure of personal information about them to third parties for direct marketing purposes. Unless noted in this Policy, our policy is not to disclose personal information collected online to a third party for direct marketing purposes without your approval. SECURITY

To help protect the privacy of data you transmit through the Services and Site, where personal information is requested, we use technology designed to encrypt the information that you input before it is sent to us. In addition, we take commercially reasonable steps to protect data that we collect through the Services and Site against unauthorized access. However, you should keep in mind that the Services and Site are run on software, hardware and networks, any component of which may, from time to time, require maintenance or experience problems or breaches of security beyond our control.

Please also be aware that despite our best intentions and the guidelines outlined in this Policy, no data transmission over the Internet or encryption method can be guaranteed to be 100% secure.

DATA RETENTION; DELETION

We periodically remove information from our databases, unless retention is required or permitted by applicable law.

CHILDREN

As a general matter, the Sites and Services are not intended for use by children. We do not knowingly collect any personal information from children younger than the age of thirteen (13) through our Sites and Services.  We will endeavor to delete any personal information collected that we later determine to be from a user younger than the age of thirteen (13). If you are a parent or guardian of a child under the age of thirteen (13) and believe he or she has disclosed personal information to us, please contact us at the email below.

CORRECTIONS, UPDATES, UNSUBSCRIBE

Please email us at the email address below if you wish to correct your information. We will use commercially reasonable efforts to correct or update our records. For our records, we may retain original and updated information for reasons such as technical constraints, dispute resolution, troubleshooting, and agreement enforcement.

You have the right to ask us not to process your personal information for marketing purposes. You can exercise your right to prevent such processing by contacting us at the email address below.

OTHER THIRD-PARTY SITES AND APPLICATIONS

This Policy only addresses the use and disclosure of information collected from you by Hosta. You should be aware that when you are using the Services, you may also use or be directed to other websites, applications or services of third parties that are beyond our control, and Hosta is not responsible for the privacy practices of third parties or the content of their websites, applications or services. We encourage you to read the posted privacy policy whenever interacting with any third party website, application or service.

POLICY CHANGES AND UPDATES

Hosta reserves the right to update this Policy from time to time, with such changes to be effective from the moment a revised Policy is posted on this website.

GOVERNING LAW

We, and our servers, are located in the United States and are subject to the applicable U.S. local and national laws. When you choose to use our Sites and Services, you do so on your own initiative and understanding that your use of the Sites and Services and our use of Your Information is subject to U.S. laws and regulations. If you choose to use our Sites and Services, you consent to the use and disclosure of information in accordance with this Policy and subject to such laws, including the transfer of your Personal Data to servers located in the United States.
